TOPIC – How To Effectively Handle Code Enforcement With Respect to Foreclosed Properties

Sharon began her presentation by stating Michigan is ranked 5th in the nation for foreclosures. She discussed the two types of foreclosures: Mortgage Foreclosure and Property Tax Foreclosure.

Mortgage Foreclosure: The legal proceeding in which the financier of a mortgage seeks to regain the property because the homeowner has defaulted on the loan.

Property Tax Foreclosure: Proceedings begun by the county treasurer when the homeowner defaults on local property taxes.

Sharon went on to explain who is hurt by foreclosures for example, individual homeowners/residents, renters, banks and financial institutions, neighborhoods, & local government units. She also discussed why it is important to know the current owner of record. In order to issue a citation, or warning letter the current owner must be notified to satisfy due process and you must use due diligence in finding out who is the current owner of record. When sending a notice to an individual, the notice should list the accurate name and address of the owner. If the owner of the property is a bank, the notice should list the accurate name of the bank. A few ways to find the current owner of record are through municipal records, Assessing Department records and the County Register of Deeds (www.landaccess.com). All banks and financial institutions doing business in Michigan must have a registered agent located in Michigan. This registered agent is the person legally authorized to accept service on behalf of the bank. You must find out the name of the registered agent and send the notice to that individual. The citation should not be issued to the registered agent. The citation should not be issued to the registered agent. The citation should be issued in the name of the owner but sent c/o the registered agent.

President Niland requested a motion to approve the minutes from January 13, 2009. Member Haluska made a motion to approve the minutes. Member Ervin supported the motion. The motion carried.

TREASURER’S REPORT
Treasurer Martin reported we have $10,713.30 in our savings account. Member Haluska motioned to approve the Treasures report, the motion was supported. The motion carried.
